DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) is concluded electronically between:

Operating under the brand name Rabbit Flow

and

Buyer

The individual or legal entity purchasing products or services via www.rabbitflow.co (“Website”).

The Seller and the Buyer shall hereinafter be referred to individually as a “Party” and collectively as the “Parties”.

By placing an order on the Website, the Buyer confirms that they have read, understood, and accepted this Agreement and all related policies.

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is the sale and delivery of goods and/or provision of services offered by the Seller to the Buyer through the Website, in accordance with this Agreement and applicable EU consumer legislation.

3. FORMATION OF THE AGREEMENT

3.1. This Agreement is deemed concluded when:

  • The Buyer confirms the order electronically, and

  • The Seller confirms receipt of the order by electronic means.

3.2. Order confirmation does not constitute acceptance if payment authorization fails.

4. PRODUCT / SERVICE INFORMATION

The essential characteristics, prices, taxes, delivery costs, and payment details of the goods or services are presented:

  • On the relevant product page, and

  • During checkout, prior to order confirmation.

All prices are displayed inclusive of VAT, unless otherwise stated.

5. PRICE, PAYMENT & DELIVERY

5.1 Price and Payment

  • Total price (including taxes and delivery costs) is shown at checkout

  • Payment methods are displayed during checkout

  • No hidden or undisclosed costs apply

5.2 Delivery

  • Orders are dispatched within 1–3 business days

  • Delivery is completed within a maximum of 30 days, unless otherwise agreed

  • Delivery is made to the address specified by the Buyer

If performance becomes impossible, the Buyer will be informed without undue delay and all payments will be refunded within 14 days.

6. BUYER OBLIGATIONS

The Buyer undertakes to:

  • Provide accurate and complete information

  • Ensure availability at the delivery address

  • Inspect goods upon delivery and report visible defects immediately

Failure to inspect goods upon delivery constitutes acceptance of goods in good condition, without prejudice to statutory warranty rights.

7. SELLER OBLIGATIONS

The Seller undertakes to:

  • Deliver goods/services in conformity with the Agreement

  • Ensure goods are complete, intact, and compliant with EU consumer law

  • Provide instructions and documentation where applicable

The Seller may supply a product of equal quality and price only with the Buyer’s prior express consent.

8. RIGHT OF WITHDRAWAL

If the Buyer qualifies as a consumer under EU law, the Buyer has the right to withdraw from this Agreement within 14 days without giving any reason.

Details on withdrawal procedure, effects, exceptions, and the withdrawal form are provided in the:

  • Preliminary Information Form

  • Withdrawal Form
    available on the Website.

9. RETURNS & REFUNDS

  • Refunds are made within 14 days after receipt of withdrawal notice

  • Refunds are processed using the original payment method

  • The Seller may withhold refund until goods are returned or proof of return is provided

The Buyer is responsible for diminished value resulting from use beyond what is necessary to establish the nature and functioning of the goods.

10. COMPLAINT HANDLING

Complaints may be submitted via:

The Seller will make reasonable efforts to resolve complaints promptly.

11. INTELLECTUAL PROPERTY

All intellectual property rights related to the Website, products, content, designs, and materials belong to the Seller or its licensors.
No rights are transferred to the Buyer by virtue of this Agreement.

12. LIABILITY

The Seller shall not be liable for indirect or consequential damages, except where liability cannot be excluded under mandatory law.

Nothing in this Agreement limits statutory consumer rights.

13. FORCE MAJEURE

Neither Party shall be liable for failure or delay caused by events beyond reasonable control, including natural disasters, governmental actions, or technical failures.

14. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Netherlands.

Disputes may be submitted to:

  • The competent courts of the Netherlands, or

  • An EU alternative dispute resolution body

Consumers may also use the EU Online Dispute Resolution (ODR) platform.

15. FINAL PROVISIONS

  • The Seller may update this Agreement; changes take effect upon publication

  • If any provision is invalid, remaining provisions remain in force

  • This Agreement is stored electronically and may be requested by the Buyer
